KJC Nature Bare “12 Days of Giftmas” Promotion – Terms & Conditions

These Terms and Conditions (“Terms”) apply to the “12 Days of Giftmas” promotion (“Promotion”) conducted by KJC Nature Bare (ABN 48 662 112 110 (ACN 662 112 110)], trading as KJC Nature Bare), throughout the KJC Nature Bare website: https://kjcnaturebare.com.au/ (“Website”). By participating in this Promotion, you (“Customer” or “you”) agree to be bound by these Terms, as well as KJC Nature Bare’s general terms of sale, privacy policy, and all other policies referenced on our Website. To the extent of any inconsistency, these Terms will prevail.

1. Promotion Period
1.1 The Promotion runs from 13 December 2024 to 24 December 2024 (inclusive), or until stock allocated for the daily promotion is exhausted, whichever occurs first.
1.2 KJC Nature Bare reserves the right to vary, extend, or withdraw the Promotion at any time, subject to applicable law.

2. Eligibility
2.1 This Promotion is open to Australian residents aged 18 years or over.
2.2 By placing an order, you warrant that you meet the eligibility criteria.

3. Daily Gift Offer
3.1 Each day during the Promotion Period, KJC Nature Bare will offer a complimentary product (“Daily Gift”) to the first five (5) orders placed that have a total order value (excluding shipping and any discounts) exceeding AUD $50 (“Qualifying Purchase”).
3.2 The Daily Gift will be announced on the Website each promotional day.
3.3 Once the allocation of five (5) Daily Gifts has been exhausted for that day, no further gifts will be given out that day.
3.4 The Daily Gift is provided at no additional charge and cannot be exchanged or substituted for another product, store credit, or cash, unless required by law.
3.5 The Daily Gift is limited to one per qualifying order. If you place multiple qualifying orders on a given day, only the first qualifying order may receive the Daily Gift, subject to availability.

4. Specific Offer on 13 December 2024
4.1 On 13 December 2024, the Daily Gift will be a KJC Nature Bare gift voucher valued at AUD $30 (“$30 Voucher”).
4.2 The $30 Voucher must be used between 13 December 2024 and 31 January 2025. After 31 January 2025, the $30 Voucher will expire and any unused balance will be forfeited.

5. Return and Refund Conditions
5.1 If a Customer returns any part of their order and obtains a refund that results in the original order total falling below AUD $50 (thereby disqualifying the original order as a Qualifying Purchase), the Customer will be charged the full retail price of the Daily Gift initially provided.
5.2 The retail price of the Daily Gift will be deducted from the refund amount. If the refund amount does not cover the retail price of the Daily Gift, KJC Nature Bare may, at its discretion, seek additional payment from the Customer for the difference.
5.3 This clause does not limit your rights under the Australian Consumer Law or other consumer protection laws that may apply.

6. The $400 Voucher Draw on 25 December 2024
6.1 On 25 December 2024, KJC Nature Bare will conduct a random draw to award one (1) AUD $400 KJC Nature Bare gift voucher (“$400 Voucher”) to a Customer who placed at least one order on the Website between 13 December 2024 and 24 December 2024 (inclusive).
6.2 Each qualifying order placed during the specified period receives one entry into the draw.
6.3 The $400 Voucher must be used between 25 December 2024 and 31 January 2025. Any unused balance after 31 January 2025 will expire and be forfeited.
6.4 The $400 Voucher cannot be exchanged for cash, nor can it be transferred or sold.

7. Claiming Prizes
7.1 The winner of the $400 Voucher will be notified by email to the email address associated with their order.
7.2 The winner must claim the $400 Voucher within 48 hours of the initial notification email being sent.
7.3 If the winner does not claim the $400 Voucher within the specified 48-hour period, the winner is deemed to have forfeited the prize, and KJC Nature Bare may, at its sole discretion, redraw the prize and award it to another participant.

8. Limitation of Liability
8.1 To the extent permitted by law, KJC Nature Bare’s liability for any loss or damage arising out of or in connection with the Promotion is limited to the cost of supplying a replacement prize or benefit.
8.2 Nothing in these Terms excludes, restricts, or modifies any right or remedy or any guarantee, warranty or other term or condition implied or imposed by any statute (including the Australian Consumer Law) which cannot lawfully be excluded or limited.

9. Privacy
9.1 By participating in this Promotion, you consent to KJC Nature Bare collecting and using your personal information for the purpose of administering the Promotion and notifying winners.
9.2 KJC Nature Bare’s Privacy Policy available on our Website applies to all personal information collected in connection with the Promotion.

10. General
10.1 KJC Nature Bare reserves the right to vary these Terms at any time, including to address any misuse, interpretation, or unintended consequences of the Terms, subject to applicable laws.
10.2 These Terms are governed by the laws of the State of [insert relevant State or Territory] and the Commonwealth of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of that jurisdiction.
10.3 If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision may be severed and the remaining provisions will continue in full force and effect.
